These Terms of Use ("Terms") govern access to and use of the Concrete Visualizer website and related services (the "Service"). By using the Service, you agree to these Terms.

1) What the Service Does

Concrete Visualizer provides conceptual "before/after" visualizations generated from photos you upload and the options you select. The Service is intended for inspiration and marketing, not engineering, permitting, or construction planning.

2) Conceptual Visuals Only (Important Disclaimer)

• Generated images are conceptual previews and may not reflect real-world feasibility, site conditions, drainage, grading, structural requirements, codes, permits, or final appearance.
• Do not rely on generated images for safety decisions, engineering decisions, permit applications, or construction specifications.
• Any pricing, timelines, or scope are determined solely by the contractor you choose.

3) User Submissions (Photos, Inputs, and Content)

When you upload a photo or submit information, you represent that:

• You own the photo or have the right to use it.
• You have permission from anyone whose property, likeness, or personal information appears in the photo.
• Your content does not violate any law or rights of others.

You agree not to upload:

• Illegal content, sensitive personal documents, or content that infringes intellectual property.
• Content containing private, confidential, or sensitive information you do not have the right to share.

4) License to Operate the Service

You grant Concrete Visualizer a limited, worldwide, non-exclusive license to use your uploaded content and inputs solely to:

• Provide the Service (including generating images),
• Maintain, troubleshoot, and improve reliability and quality,
• Comply with legal obligations and enforce these Terms.

We do not claim ownership of your original uploaded photo.

5) Ownership of Outputs

As between you and Concrete Visualizer:

• You retain rights to your original uploads.
• The generated images are provided to you for personal use and to share with contractors for evaluation and estimating.
• You may not resell, sublicense, or mass-distribute generated images as a standalone product without our written permission.

6) Contractor Leads and Referrals

If you submit contact information, you understand we may share your details and the generated results with a contractor or contractor account associated with your request, so they can contact you about an estimate.

We are not responsible for:

• A contractor's work quality, pricing, scheduling, warranties, or communications,
• Any agreements you enter into with a contractor.

7) No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

8) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONCRETE VISUALIZER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE PRIOR 3 MONTHS OR (B) $100.

9) Acceptable Use and Abuse Prevention

We may throttle, suspend, or block use if we reasonably believe you are abusing the Service, attempting to reverse engineer it, scraping it, submitting spam, or interfering with normal operations.

10) Changes to the Service

We may modify or discontinue the Service (in whole or in part) at any time. We are not liable for changes or downtime.

11) Termination

We may suspend or terminate access to the Service for violations of these Terms or to protect the Service and users.

12) Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of laws principles.
